Data diddling is the most common form of crime which is carried out by input manipulation. It involves changing the data before or, during its entry into the computer. It also includes adding, changing the data with malicious intentions during or before feeding it into a computer. It does include fraudulent data input, altering the data, wrongly posting the transaction etc.
Leakage refers to illegally copying the information for ransom, blackmailing or other fraudulent purposes. Scavenging indeed refers to using information which might have been left over.
Added to this list are software crimes which arise due to affected software or a corrupted one. Similarly, there could be hardware defects as are seen in the recent case of defects in the computer chips. One finds it difficult to keep pace with such developments and more particularly be absolutely careful in applying the security patches provided for by the software companies from time to time.
We must also issue a general note of caution in respect of devices attached to innumerable utilities like cars, fridges etc. There are cases where some playthings for children place orders and the parents were hard put to get them cancelled. Ultimately, they succeeded through an intervention of the court. The ease with which routine and sometimes even complicated tasks can be resolved with the help of machines brings with it the possible dangers of subversion, and an exposure to a host of crimes.
It is now pretty obvious that many of our assumptions regarding acceptability of evidence, or rules regarding checks are undergoing some fundamental changes and with transfer of cash/making payments through mobile devices we are moving to a cashless society and countries like Kenya, China turning themselves into cashless societies and countries like India being on the way, a major transformation almost of revolutionary proportions is taking place. So are the crimes on a steep upward curve. Commercial laws or even criminal laws are slow to catch up with vastly changing practices and individuals and institutions will need to exercise utmost caution while using these services. The acts which have been modified or are in urgent need of modification are Criminal laws, Evidence Act, Bankers’ Rules for Negotiable Instruments, Fraud squads, Cyber Divisions, and so on may help but our own vigil and constant watch on our transactions is of paramount importance.
